Year End Review of the TN Category

As 2012 is coming to an end, Berardi Immigration Law is taking a look at past TN blogs and videos and re-posting some of our “favorites” that we believe will help guide you in the TN process.

  1. Basic overview of the TN category: The 1994 North American Free Trade Agreement (NAFTA) makes temporary employment in the U.S. easier for certain Canadian and Mexican workers. NAFTA created a new classification, “TN,” for eligible Canadian and Mexican professional workers.
  2. Professions that qualify as a TN: TN employment must be in a profession listed in Appendix 1603.D.1 to NAFTA and the TN employee must possess the credentials to be considered a professional in one of the listed fields.
  3. Recent filing changes to the TN: U.S. Citizenship and Immigration Services (USCIS) is now accepting Form I-129, Petition for Nonimmigrant Workers, filed on behalf of Canadian citizens seeking TN classification under NAFTA.  Prior to this, USCIS only accepted Form I-129 in connection with a request to extend a TN nonimmigrant’s stay, or to change a nonimmigrant’s status to TN.
  4. The importance of the degree for the TN: Even if your degree is not the “normal” degree that is earned for a specific profession, you still may qualify for a TN.
