USCIS Changes Filing Addresses for Certain Form I-140s3Starting on October 19, 2015, there will be new direct filing addresses for Form I-140 Immigrant Petitions requesting Premium Processing Service through Form I-907. This change will only be applicable to worksite locations in Maryland, New Jersey, New York, or Pennsylvania.
Announced last week, Form I-140 and Form I-907 should be filed with the Nebraska Service Center using the following address:
If sending via Regular Mail: Premium Processing USCIS Nebraska Service Center, P.O. Box 87103, Lincoln, NE 68501-7103
If sending via Express Delivery: Premium Processing USCIS Nebraska Service Center, 850 S. Street, Lincoln, NE 68508
Any pending I-140 Immigrant Petitions can be upgraded to Premium Processing by having a completed Form I-907 sent to the service center that has the pending Form I-140. By requesting Premium Processing, the Immigration Service will take action on the I-140 Immigrant Petition for Alien Worker petition within 15 calendar days. If not, the $1,225.00 Premium Processing filing fee will be refunded.
Only certain categories of I-140 Immigrant Petitions are eligible for Premium Processing. These include:

  • EB-1 Aliens of Extraordinary Ability;
  • EB-1 Outstanding Professors and Researchers;
  • EB-2 Members of Professions with Advanced Degrees or Exceptional Ability Not Seeking a National Interest Waiver;
  • EB-3 Workers Other Than Skilled Workers and Professionals; and
  • EB-3 Skilled Workers and EB-3 Professionals may be eligible for Premium Processing, but will be subject to certain conditions.

Categories that are not eligible for Premium Processing include EB-1 Multinational Executives and Managers, and EB-2 Members of Professions with Advanced Degrees or Exceptional Ability Seeking a National Interest Waiver.
It is important to note that only an employer is allowed to file a Premium Processing request for an I-140 Immigrant Petition that requires an employer as the petitioner. However, the beneficiary of an Immigrant Petition, can request Premium Processing for a self-petition, meaning that both the petitioner and beneficiary are the same, with either party paying the Premium Process filing fee.
